Former Elite Officer Charged in South African Whistleblower Murder

Charges filed against a former elite officer in the killing of a key witness in South Africa's police corruption probe.

Matipandile Sotheni, a 41-year-old former member of an elite police unit, has been charged with the murder of Marius van der Merwe, a whistleblower who testified at a major inquiry into police corruption in South Africa. Sotheni allegedly shot Van der Merwe in December last year, in full view of his family, an act that sparked national outrage and highlighted risks faced by those exposing official misconduct.

Details of the Incident and Arrest

Police identified Sotheni as the alleged hitman in the drive-by shooting, with another suspect, Wiandre Pretorius, serving as the driver before killing himself. Authorities seized the car used in the attack but are still searching for the weapon, believed to be an AK-47. Sotheni also faces charges for attempting to kill Van der Merwe's wife and children during the incident.

Van der Merwe, referred to as 'Witness D' during the inquiry, had testified about the torture and murder of a robbery suspect, Emmanuel Mbense, in April 2022. He accused local police chief Julius Mkhwanazi of ordering him to dispose of Mbense's body, leading to Mkhwanazi's suspension, though no arrests have been made in that case.

The Madlanga commission, established by President Cyril Ramaphosa, was formed after allegations that organized crime had infiltrated government ranks. This inquiry resulted in the suspension of several officers named by Van der Merwe and even led to the suspension of Police Minister Senzo Mchunu, who denies any criminal links.

In related developments, three of the 12 individuals implicated in Mbense's killing have died: two were shot, and one committed suicide. South Africa's parliament is actively investigating these broader allegations of police corruption.

Sotheni appeared in court following his arrest over the weekend, and the case has been postponed to March 25 for a bail application. This event underscores the challenges in combating corruption within South African law enforcement, as the National Prosecuting Authority continues its pursuit.
